Terms of Service

These Terms of Service govern your use of the NitroArena platform (nitroarena.com) operated by KMX Software Sp. z o.o. By signing up for the beta program — whether through the web form or via the Sandbox API — you agree to these terms.

§1. General Provisions

The NitroArena platform is operated by KMX Software Sp. z o.o., registered at ul. Węgierska 13, 37-200 Przeworsk, Poland, NIP: 8151809695 (hereinafter "the Operator").

NitroArena is a multi-tenant control plane for orchestrating AI agents — defining tasks, routing inbox messages, scheduling actions, and auditing every step.

§2. Definitions

• Platform — the NitroArena web application available at nitroarena.com and its subdomains.
• User — any natural person or legal entity that registers for the beta program.
• Account — a User's profile and configuration within the Platform.
• Service — all functionalities provided by the Platform, including API and MCP access.
• Agent — an AI-powered tool or assistant connected to the Platform via API or MCP.
• Tenant — an isolated workspace within the Platform assigned to a User or organization.

§3. Registration and Consent

To join the beta program, Users provide personal data through the signup form or via the Sandbox API. Required data includes first name, last name, and email address. Optional data includes phone number, country, address, company information, and roles.

The provided email address will be used for communication regarding the beta program, including confirmation emails, access credentials, and platform updates sent from [email protected].

By signing up, you consent to: (a) processing of your personal data for beta program purposes, (b) receiving email communication about the beta program from [email protected], and (c) your anonymized data (initials, country, roles) being displayed on the public landing page.

§4. Beta Program

Participation in the beta program is free of charge. The first 100 active beta testers qualify for the Pioneer tier, which includes founding member status, a "Pioneer" badge, and priority access to new features.

Data collected during the beta program is used for testing, improving the platform, and communicating with participants. The Operator reserves the right to modify or discontinue the beta program at any time.

§5. Use of Platform

Users interact with the platform via the web dashboard (read + administer) and via API/MCP (where AI agents drive the workflow). The Operator does not control which agents Users connect or what those agents do on the User's behalf.

Users are responsible for the actions of their connected AI agents and must ensure they comply with these Terms and with the terms of any third-party services those agents call.

§6. Intellectual Property

All content, design, code, and trademarks related to the NitroArena platform are the property of KMX Software Sp. z o.o. and are protected by applicable intellectual property laws.

§7. Limitation of Liability

The Platform is provided "as is" without warranty of any kind, express or implied. The Operator does not guarantee uninterrupted or error-free operation, particularly during the beta period.

To the maximum extent permitted by law, the Operator shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Platform.

§8. Changes to Terms

The Operator reserves the right to modify these Terms. Users will be notified of significant changes at least 14 days in advance via email. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
